TERMS AND CONDITIONS

I. Introductory Provisions

  1. These General Terms and Conditions (hereinafter referred to as "GTC") are an integral part of the Motor Vehicle Rental Agreement (hereinafter referred to as the "Agreement").

  2. These GTC further define the mutual rights and obligations of the Lessor and the Lessee in connection with the Agreement concluded between the Lessor and the Lessee.

  3. The Lessee is obliged to familiarize themselves with these GTC before concluding the Agreement.

  4. Provisions deviating from the GTC may be negotiated in the Agreement. Deviating arrangements in the Agreement take precedence over the provisions of the GTC.

  5. The Lessor is the company Zuluf auto s.r.o., ID: 06937802, VAT ID: CZ06937802, with its registered office at Na Vartě 66, 250 69 Máslovice, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 291693 (hereinafter referred to as the "Lessor").

  6. The Lessor reserves the right to change, supplement, or otherwise modify the wording of these GTC.

II. Subject of Lease

  1. The subject of the lease is specified in the Agreement.

  2. The rent for the subject of the lease is agreed upon in the Agreement. The rent does not include fees for the use of highways and expressways outside the Czech Republic.

  3. The Lessee is obliged to pay the rent for the entire rental period to the Lessor's account, by wire transfer, via a payment terminal, or in cash before taking over the motor vehicle, including the security deposit (bond), which will be returned within 30 days of the return of the vehicle, provided all conditions are met. Subsequently, the Lessor shall issue an invoice within 10 days of the termination of the lease for the vehicle in question.

III. Security Deposit

  1. The Lessee is obliged to pay the Lessor a refundable security deposit in the amount specified in the Agreement, at the latest upon signing the Agreement, in cash, via a payment terminal, or by transfer to the Lessor's account.

  2. The deposit is intended to cover any debts of the Lessee arising from the Agreement. The Lessee expressly agrees that the Lessor is entitled to unilaterally offset the deposit against the payment of rent, fees, contractual penalties, damages, fines imposed by state administration authorities or the Police of the Czech Republic, and other claims of the Lessor arising from the Agreement, in accordance with the Agreement.

  3. The Lessor shall return the unused deposit to the Lessee no later than 30 days after the termination of the lease, provided the Vehicle was not damaged. If the Vehicle was damaged, the Lessor shall return the deposit (or part thereof) to the Lessee no later than 90 days after the termination of the lease.

  4. The Lessor may require the Lessee's consent to perform a "late charge" payment up to the amount of CZK 100,000, by which the Lessee enables the Lessor to satisfy its claims against the Lessee arising from or in connection with the Agreement from the Lessee's payment or credit card.

IV. Handover of the Subject of Lease, Lease Term

  1. The maximum lease term is specified in the Agreement.

  2. The place of handover of the subject of the lease to the Lessee, as well as the place of its return to the Lessor, is the Lessor's premises at: Pražská 180, 250 66 Zdiby, unless agreed otherwise.

  3. The lease term expires at the latest on the day specified in the Agreement. If the Lessee does not return the subject of the lease on this day and fails to prove that an insured event occurred preventing its return, the Lessor is not obliged to release the vehicle brought by the Lessee until the return of the subject of the lease or until the existence of the insured event is proven.

  4. The subject of the lease is always handed over to the Lessee with a full fuel tank. The Lessee is obliged to return the subject of the lease with a full fuel tank. In case of breach of this obligation, the Lessee is obliged to pay the Lessor a contractual penalty of CZK 3,000 excluding VAT. The contractual penalty is payable within 14 days of the written request for payment.

  5. Smoking is prohibited in the subject of the lease. In case of breach of this obligation, the Lessee is obliged to pay the Lessor a contractual penalty of CZK 5,000 excluding VAT. The contractual penalty is payable within 14 days of the written request for payment.

  6. The Lessee is obliged to maintain the subject of the lease in a clean condition, both its exterior and interior. In case of breach of this obligation, the Lessee is obliged to pay the Lessor a contractual penalty of CZK 3,000 excluding VAT. The contractual penalty is payable within 14 days of the written request for payment. The right to claim damages is not affected.

  7. The Lessee is responsible for damage, destruction, theft, or loss of the subject of the lease and is also responsible for misdemeanors or criminal offenses committed with the subject of the lease during the term of the lease.

  8. The Lessor is entitled to demand the return of the subject of the lease even before the expiry of the agreed lease term. The Lessor is entitled to call upon the Lessee to return it via telephone, SMS, or e-mail, whereby the Lessee is obliged to return the subject of the lease to the Lessor the following day, no later than 10:00 AM, at the address: Pražská 180, 250 66 Zdiby.

  9. In the event that the Lessee breaches the obligation to return the Subject of Lease within the agreed period, the Lessee is obliged to pay the Lessor a contractual penalty of CZK 2,000 excluding VAT for each started day of delay.

V. Vehicle Usage Conditions

  1. The vehicle may only be used and driven by persons specified in the GTC with a valid driver's license who have reached the age of 21. The Lessee is obliged to use the vehicle exclusively for the purpose of road traffic, for personal purposes, and to comply with all traffic, customs, and other legal regulations, as well as all instructions given in the vehicle manufacturer's manual.

  2. In the case of an alternative fuel vehicle (e.g., natural gas, electricity), the Lessee confirms by signing the GTC that they have familiarized themselves in detail with the operating conditions, vehicle operation, refueling/charging, and parking/garaging instructions.

  3. The Lessee is obliged to ensure that no damage occurs to the vehicle and to follow all operating instructions in the manufacturer's manual and the Lessor's instructions; otherwise, the Lessee is liable for all damage caused by non-compliance. The Lessee must secure the vehicle against theft or misuse. Specifically, they must not leave keys or documents in the vehicle and must lock the vehicle when parked. The Lessee must immediately inform the Lessor of the need for regular service inspections.

  4. The Lessee must not allow anyone other than the persons listed in the GTC to use the vehicle, participate in races or competitions, use the vehicle for paid transport of persons or property, use it for towing, or make any changes to the vehicle without the Lessor's written consent. Use of the vehicle for travel to countries in violation of the GTC is prohibited. In case of unauthorized travel abroad, the Lessee shall pay a contractual penalty of CZK 5,000 excluding VAT per violation.

  5. The Lessee must not drive the vehicle under the influence of alcohol, narcotics, medications, or other substances that may affect perception and reaction time.

VI. Limitation of Liability (Deductible/Co-payment)

  1. In the event of an insured event, the Lessee must provide full cooperation, report the event to the Police, fill out the "Traffic Accident Report," and inform the Lessor immediately. Failure to do so makes the Lessee liable for any recourse from the insurance company. If the insurance does not cover the damage in full, the Lessee is obliged to pay the uncovered part.

  2. In case of proven theft, the Agreement terminates on the day the Lessor receives documentation from the law enforcement authorities stating the investigation status.

  3. In case of total destruction (write-off), the Agreement ends on the day the Lessor receives confirmation from the insurance company or an expert. In these cases, the entire deposit will be used to cover the incident.

VII. Cancellation Policy

  1. If the Lessee cancels the order more than 7 days before the start of the lease, a cancellation fee of CZK 2,000 excluding VAT will be charged for administrative costs.

  2. If the Lessee cancels between the 7th day and 48 hours before the start, a cancellation fee of 50% of the rent will be charged (maximum 14 days of rent).

  3. If the Lessee cancels less than 48 hours before the start or after the agreed takeover time, a cancellation fee of 100% of the rent will be charged (maximum 14 days of rent).

  4. Violation of any obligation in the GTC is considered a material breach. The Lessee is then liable for all damages in full, regardless of the agreed deductible, and must pay a contractual penalty of CZK 20,000 excluding VAT.

VIII. Final Provisions

  1. All agreements between the Lessor and the Lessee are governed by the laws of the Czech Republic.

  2. For out-of-court dispute resolution, the consumer may contact the Czech Trade Inspection Authority (Česká obchodní inspekce), www.coi.cz, or use the ODR platform at https://webgate.ec.europa.eu/odr/.

  3. The Lessor is entitled to change these GTC in accordance with legal regulations. Rights and obligations are always governed by the version of the GTC in effect at the time they arose.

These General Terms and Conditions enter into force and effect on April 7, 2024.
